https://aleph.edinum.org:443/3333 Entrées d’index fr 0 https://aleph.edinum.org:443/4772 الدراسة تقدم الوضعية القانونية الحقيقية لإيداع المصنفات الأدبية والفنية في الجزائر وهذا بعرض النصوص التشريعية المنظمة لهذا المجال والمهام المنوطة للديوان الوطني لحقوق المؤلف والحقوق المجاورة، منذ بدء حق المؤلف بالجزائر إلى 2017. الدراسة تقدم إحصاءات حول أصناف المصنفات المعنية بالحماية التي قمنا بفرزها بعد معاينة الميدان، كما تم تحليل فحوى النصوص القانونية التي تبين مجال وحدود تدخل الديوان وكيف ذلك، ليتم بعد ذلك بحث الأسباب التي تؤثر على فعل الإيداع ووتيرته بالإعتماد على القوانين والتعديلات الحاصلة فيها مع تحليل لمضامين هذه الأخيرة سندا وإحصائيا، للوصول إلى معرفة الأسباب الحقيقية لعزوف أصحاب الحقوق عن الإيداع للإنتفاع من الحفاظ على الحقوق بواسطة ONDA. L'étude présente la réalité juridique du dépôt des œuvres artistiques et littéraire en Algérie. Elle examine les conditions de mise en conformité avec les textes de lois en vigueur depuis l'instauration du doit d'auteurs et droits voisins jusqu'en 2017.Le travail fournit des statistiques sur la typologie des œuvres concernées par la protection telles qu'elles résultent de l'observation des données ainsi qu'une analyse des textes de loi, les conditions qui président à leurs modifications et les changements introduits. Cette étude par l'observation et l'analyse des données vise en définitive à révéler les obstructions et les écueils auxquels sont confrontés les droits d'auteur garantis par l'ONDA. The study presents the legal reality of the deposit of artistic and literary works in Algeria. It examines the conditions of compliance with the laws in force since the establishment of copyright and related rights until 2017. The work provides statistics on the typology of works concerned by the protection as they result from the observation of the data as well as an analysis of the legal texts, the conditions governing their modification and the changes introduced.
